Our total aggregate liability for any claims arising from these terms or use of the platform shall not exceed the greater of $50 USD or the amount you paid (if any) to iWebGames in the past six months. Because most games are free, liability is extremely limited.
This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability) and even if we have been advised of the possibility of such damages. Certain laws may not allow the exclusion of incidental damages, so this may not apply to you.

Any legal action or proceeding relating to your access to or use of the platform shall be instituted exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
Before filing a claim, you agree to attempt informal resolution by contacting us at legal@iwebgames.com. If the dispute cannot be resolved within 60 days, either party may initiate binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for IP infringement.
Class action waivers apply: you agree to bring claims only in your individual capacity, not as a class representative.
iWebGames is designed for users aged 13 and above. By using the platform, you confirm that you are at least 13 years old. If you are between 13 and 18, you represent that you have parental or legal guardian consent to use the services. We do not knowingly collect personal information from children under 13 without verifiable parental consent. If we learn that a child under 13 has provided us with personal data, we will delete it immediately.
Parents and guardians are encouraged to supervise minors' online activities, especially chat or multiplayer interactions.
